The accusation against a media staff shouldn’t be turned into an instrument of pressure by the government on the freedom of expression

On 7th of February 2018, security officials in Kandahar province announced they thwarted explosives that has been allegedly mounted in a reporter microphone in Kandahar province. It was said that these explosives was designed to assassinate General Abdul Raziq, the Kandahar provincial police commander, which was discovered and defused before the attack took place.Security officials in Kandahar about three months ago arrested Ahmadullah Sargand, former director of the local radio station named Kelid in Kandahar province, on charges of cooperating with terrorist groups, but a microphone with full of explosives last week in one of the rooms in the radio station, which was previously checked and stamped by the police officer, was discovered and defused.

The Nai office, supporting open media in Afghanistan), the publication and distribution of allegations by security officials against the one who was accused by the police, which the court hasn’t announced the final decision yet, is a hasty and against the law act, that in such a sensitive situation, pose the lives of members of family, colleagues and friends of the defendant (Mr. Sargand) under risk.

The Afghan government, based on the valid law, can not provide detailed information on the defendants before the court’s decision.

On the other hand, Afghanistan’s media should wait for the final decision of the court in such cases and refrain from publishing and disseminating information that may harm the members of the accused family.

Article 26 of the Afghan Constitution explains that “the crime is a personal act, the prosecution, impeachment or imposition of a punishment on him; does not spread to another person.”

As the constitution of Afghanistan recognizes crime as a personal act, the Nai Office, while requesting a comprehensive investigation of this case, asks the National Unity Government that this issues shouldn’t be a pressure instrument against Mr. Sargand’s family, his colleagues, or in general on the freedom of expression and media in the country.
