Amrullah Saleh, the First Vice President has fired four employees of Interior Ministry for publishing and sharing information with media.
However, the Afghanistan constitution Article 50 recognizes access to information as the right of every citizen and obliges the government to provide information to citizens based on their request. According to the Law on access to information Article 26, who has reveal information in good faith, has administrative and legal immunity, and should be supported, accordance to provision of the law.
In the view of provision of the mentioned laws, government has no right to interrogate, punish, and compulsory dismiss employees of the Ministry of Interior for sharing information, unless the information is shared against the law.
The dismissal of Interior Ministry employees is against the Afghanistan labor law, and thus Afghan government should deal with these individuals based on the law, and apologize to them.
And also, these people should be recruited to their pervious duties.
Nai believes that if the punishment of government employees for reveal of legal information continues, the process of corruption revelation in government institutions will be stopped, and will be a great harm to the free flow of information.
