The oversight commission on access to Information on the basis of the official complaint filed by the Nai office for insolent behavior and hiding information from “our Afghanistan” news agency journalist, has introduced minister and head of ministry of communications and Information technology to the prosecutor’s office.
The reason for the introducing of these two senior officials of the ministry of communications to the general prosecutor’s office was a violation of the access to Information act, which head of the office of the ministry of telecommunications had not provided the information requested by the” our Afghanistan” news agency journalist Ali Reza Ahmadi.
Ali Reza Ahmadi journalist of “our Afghanistan” news agency, had recently referred to the ministry of telecommunications to obtain information on the collection of ten percent of the taxes on telecommunication networks (cell phones), but did not provided him the requested information.
Based on the official letter of the oversight commission on access to Information, which has been sent to the general prosecutor’s office and a copy has been shared to the media, the head of the office of the minister of telecommunications will be referred to the Prosecutor’s office based on available grounds, but the ministry of communications and technology has not yet taken any action, while based on the law the enactment of the commission has been finalized and should be implemented.
In the end of the letter has been mentioned that the commission approved in the meeting on 9 April 2018 to request attorney general’s office to be prosecute the minister and head of the office of the ministry of communications and technology.
The Nai office, supporting open media in Afghanistan believes that the act of oversight commission on access to Information is a step forward towards the rule of law.
We expect the oversight commission on access to Information to address all complaints of journalists and citizens, and to bring such cases to justice and prosecution so that the right to information is respected as the fundamental right of citizens.
The Nai office also calls on journalists and media directors to file a complaint in case of facing violations of access to information, in accordance with the law, and to file their complaints after gathering supported information and submitted to the oversight commission on access to Information, which the offenders of the law to be introduced to the judicial and justice institutions in accordance with the law.
